Bloomberg reports that the anti-Walmart left was handed a big blow today in a 5-4 Supreme Court ruling:
The U.S. Supreme Court, in a ruling that will mean new limits on nationwide class-action suits, ruled that Wal-Mart Stores Inc. (WMT) can’t be sued for discrimination on behalf of potentially a million female workers.
The justices, dividing 5-4, said the lawyers pressing the case failed to point to a common corporate policy that led to gender discrimination against workers at thousands of Wal-Mart and Sam’s Club stores across the country.
The workers “provide no convincing proof of a companywide discriminatory pay and promotion policy,” Justice Antonin Scalia wrote for the majority. The court was unanimous on another issue, with all nine justices saying a federal appeals court applied the wrong legal rules in approving the class action.
Wal-Mart rose after the Supreme Court issued its opinion, gaining 17 cents to $52.99 at 1:25 p.m. in trading on the New York Stock Exchange. The company, based in Bentonville, Arkansas, said in a statement that the ruling “effectively ends this class-action lawsuit.”
“As the majority made clear, the plaintiffs’ claims were worlds away from showing a companywide pay and promotion policy,” Wal-Mart said.
For at least a decade the left has spearheaded a campaign to defame and destroy America’s largest employer. But all Walmart has done is continue to post record profits, provide a full range of products to its customers at an affordable price and employ more U.S. workers.
While most normal, well-adjusted people see Wal-Mart’s domestic expansion and creation of jobs as laudable, our capitalist-hating friends on the left see it as something nefarious and repugnant.
Like in 2004 when George W. Bush defeated John Kerry, I predict that the psychologists will turn out to be the biggest benefactors of this ruling as the defeated true believers flock to lie on their couches and bemoan their suicidal tendencies.
