Last November I blogged about the 5 Most Earth Shattering Tax Opinions Ever Written.
Four of the cases I cited in that post are included in Professor Caron’s list:
- Lucas v. Earl - The substance rather than the form of a transaction controls its tax treatment.
- Kirby Lumber - Debt forgiveness/cancellation is taxable income.
- INDOPCO - Costs that result in “significant future benefit” must be capitalized.
- Crane - Debt assumed by the buyer is the equivalent of money received by the seller.
